General Terms of Use applicable to private customers

Article 2 — Purpose
The purpose of these General Terms of Use (hereinafter the 'Terms') is to define the conditions of access to and use of the services offered by Vendée Domotique, in particular via its website, its applications and its online customer area (hereinafter the 'Service' or the 'Platform').
Access to and use of the Service imply full and unreserved acceptance of these Terms by the user (hereinafter the 'User').
Article 3 — Access to the Service
The Service is accessible free of charge to any User with access to the Internet. Internet access costs and the equipment required to access it are the User's responsibility.
Vendée Domotique endeavours to keep the Service accessible at all times, but cannot be held responsible for interruptions arising from maintenance operations, technical failures or cases of force majeure.
Article 4 — Account creation and customer area
4.1 — Registration
Access to certain features of the Service requires the creation of a personal account. The User undertakes to provide accurate, complete information and to keep it up to date.
The User is responsible for the confidentiality of their login credentials. Any activity carried out from their account is deemed to have been carried out by the User themselves.
4.2 — Account features
The customer area allows the User in particular to: view the history of their orders and quotes, track the progress of their installations, manage their connected home-automation equipment, and contact customer service and technical support.
4.3 — Account deletion
The User may request the deletion of their account at any time by contacting Vendée Domotique by post or email. Deletion will take effect within a reasonable period, subject to compliance with legal data retention obligations.
Article 5 — User obligations
The User undertakes to use the Service in accordance with its intended purpose and in compliance with applicable laws, not to attempt to compromise the security of the Service, not to collect or make use of other users' data, and to report immediately any security breach or fraudulent use of their account.
Article 6 — Intellectual property
All content present on the Service (texts, images, logos, videos, software, databases, etc.) is the exclusive property of Vendée Domotique or its partners and is protected by French and international intellectual property laws.
Article 7 — Protection of personal data
7.1 — Data controller
The controller responsible for processing personal data is the company CVBN (Vendée Domotique), whose registered office is located at 22 rue Georges Durand, 85280 La Ferrière.
7.2 — Data collected
Identification data (surname, first name, address, telephone, email), connection data (username, encrypted password, IP address), data relating to home-automation equipment (configuration, usage history), payment data (processed by a secure provider, not stored by Vendée Domotique).
7.3 — Purposes
Management of the business relationship, performance of contracts, management of the customer area, technical support and after-sales service, improvement of the Service.
7.4 — Legal basis
Performance of the contract (art. 6.1.b GDPR), consent (art. 6.1.a) and legitimate interest (art. 6.1.f).
7.5 — Retention period
Duration of the business relationship, followed by legal archiving (5 years for invoicing, 1 year for connection data). Prospects who have not followed up: 3 years from the last contact, in accordance with the recommendation of the CNIL.
7.6 — User Rights
In accordance with the GDPR: right of access, rectification, erasure, restriction, portability and objection. Requests may be sent by post to the registered office or by email. Response within 1 month. A complaint may be lodged with the CNIL.
7.7 — Cookies
The Service uses cookies to ensure it functions properly, analyse traffic and personalise the experience. These cookies are only placed after your explicit consent. You may change your choice at any time.
7.8 — Recipients and processors
Your data is intended solely for the departments of Vendée Domotique (CVBN). It is neither sold nor transferred to third parties for commercial purposes. The following act as processors, solely for the needs of the Service: Odoo S.A. (Belgium — hosting and messaging) and Microsoft Ireland Operations Ltd (business email).
7.9 — Transfers outside the European Union
Certain audience measurement and online advertising tools provided by Google Ireland Ltd may involve a transfer of data to the United States. These transfers are governed by the Data Privacy Framework and, failing that, by the European Commission's standard contractual clauses. These tools are only placed after your consent.
Article 8 — Security
Vendée Domotique implements appropriate technical and organisational measures to ensure the security and confidentiality of personal data, in line with best practice.
Article 9 — Connected equipment and data
Some equipment installed by Vendée Domotique may connect to the Internet and transmit data to online services managed by the manufacturers. The User is solely responsible for the management of their personal data in the context of using this equipment. Vendée Domotique has no access to data stored on the manufacturers' platforms.
Article 10 — Hypertext links
The Service may contain links to third-party sites. Vendée Domotique exercises no control over these sites and disclaims all liability regarding their content.
Article 11 — Limitation of liability
Vendée Domotique shall not be held liable for direct or indirect damages resulting from use of the Service, an interruption of the Service, loss of data, or unauthorised access to the User's account, except in the event of proven fault.
Article 12 — Amendment of the Terms and Conditions of Use
Vendée Domotique reserves the right to amend these Terms and Conditions of Use at any time. Amendments shall take effect upon publication. The User shall be informed of any substantial amendment by notification on their customer area or by email.
Article 13 — Governing law and competent jurisdiction
These Terms and Conditions of Use are governed by French law. In the event of a dispute, the parties shall endeavour to reach an amicable solution. Failing this, the competent courts shall be those of the Client's place of residence, in accordance with the Code de la consommation.
Article 14 — Right of withdrawal
Where the contract is concluded off-premises — in particular at your home during a technical visit — you have a period of fourteen (14) days to exercise your right of withdrawal, without having to justify your decision or bear any penalties (articles L221-18 et seq. of the Code de la consommation). The standard withdrawal form is provided with your quote.
If you wish the installation to begin before this period has expired, your express request must be recorded in writing or on a durable medium, in accordance with article L221-25 of the Code de la consommation. Failing this, no sum may be claimed from you for services carried out before withdrawal.
